TERMS OF SERVICE

1.) Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If you wish that we contact you by phone, fax or regular mail, then you must mention this under the client notes when signing up.

2.) Content

All services provided by Archer Networks may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, pornography. The customer agrees to indemnify and hold harmless Archer Networks from any claims resulting from the use of our services.

Examples of unacceptable material:

IRC Bots

Warez Sites

Pirated Software

Hate sites

Hack programs and archives

Pornographic material of any sort.

3.) Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice. This will be final.

Archer Networks reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. Archer Networks also reserves the right to make any such modifications in an emergency at our sole discretion.

Archer Networks reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Archer Networks. All rights reserved.

4.) Payment Information

You agree to supply appropriate payment for the services received from Archer Networks, in advance of the time period during which such services are provided. You agree that until and unless you notify Archer Networks of your desire to cancel any or all services received, those services will be billed on a recurring basis.

It is your responsibility to keep your contact and billing information up to date in the customer management (billing manager) area.

You may pay us using a credit card through our third party solutions e.g PAYPAL or you may send us mail-in Payment which can be in the form of check, money order or paying in cash personally to our representative.


If payment made by personal or company check then following FEES apply,
i. NSF (Check Returned) = $29.00
ii. Stop Payment Request = $29.00

Archer Networks reserves the right to change the monthly payment amount and any other charges at anytime. You will be notified one month in advance of any such changes.

5.) Backups and Data Loss

Your use of the service is at your sole risk. Archer Networks is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Archer Networks servers.

6.) Cancellation and Refunds

Archer Networks reserves the right to cancel the account at any time.

Customers may cancel at any time. Archer Networks gives you an unconditional 30 day money back guarantee on managed shared hosting, and reseller solution's. There are no refunds on dedicated servers or setup fees that might have been incurred at the time of signup. Refund requests after 30 days will be refunded on a prorated basis of any unused time.

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

7.) Resource Usage

Users may not initiate the following:

a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.

c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.

d) Run any software that interfaces with an IRC (Internet Relay Chat) network.

e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc

8.) Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

9.) Money back Guarantee

For claims of refund AFTER the 30 days we reserve the right to refund a prorated amount or no refund at all.

If you are not completely satisfied with our services within the first 30 days of your service, you will be given a full refund of the hosting amount. This offer is not applicable on setup fees that might be incurred during sign up. All domain registrations are non-refundable. Does not apply to Special Offers.

10.) Price Change

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Archer Networks, and the right to increase the amount of resources given to plans at any time.

SERVICES:

a.) Domain Registration

Archer Networks will provide a Free domain name for all new sign ups and transfer domains to our service for free. This free offer may change or end at any given time according to the sole discretion of Archer Networks.

Archer Networks will renew your domains automatically for free if you are currently signed up under a plan that offers free domains. This will be done 30 days before the expiration date. If for some reason you decide to leave Archer Networks and wish to keep your domain, you may do so by paying Archer Networks a domain transfer charge and transfer it to any new registrar. This charge may depend upon the uniqueness and availability of the domain name. If you wish to cancel your services and still decide to keep the domain, we will renew your domain each year at the current rate at the time of renewal. Current rates are available at http://www.archerdomains.com.

The domain TLDs that are offered FREE of charge through Archer Networks are mentioned on the Domains Page which can be found at http://www.archernetworks.com/domains.html. If a client wants to register a TLD other than the ones that come under the Free Domain offer, he/she may do so from a list of the domain TLDs offered. For any such registration the Free registration, Renewal and transfer policy shall not apply. Additionally for all such TLDs which do not come under the Free Domain Policy there shall be a separate domain Registration, Renewal and transfer rate. This will be announced either through Archer's Domain http://www.archerdomains.com or Archer Networks, http://www.archernetworks.com.

b.) Web Hosting

The rules that apply to web hosting have already been explained in section (2) section (3) and section (7). Additionally all web hosts are responsible for their own data. From time to time an Archer Networks Representative or support person may ask such users for their cpanel usernames and passwords for any maintenance and or technical issues. Archer Networks will NEVER ask you for your billing manager password and in case you forget your password you may obtain a new one automatically through the clients area.

c.) Web Development

Web Development services and charges may vary from time to time. Archer Networks provides custom web development solutions and prices for any such project will be agreed by both parties before the actual web development starts. You may be asked to provide an initial deposit as setup fees. The 30 day money back guarantee does not apply to web development setup charges. You will be shown the basic layout before you are asked to pay for it. After you pay for the web development the fees will not be refundable.

If your website and or domain is hosted by Archer Networs all the above policies will apply to you too.

For all web development plans you agree that you will not use the images, text, material that has been developed by Archer Networks for any use other than that single business or website. If you wish to use such images and or material for any other things e.g. brochures or some other website, you must obtain the approval of Archer Networks. Additionally, Archer Networks may hire free lance web designers and or outsource your project to any designers for the complete or part of any given project. Archer Networks may use resources from web designers and or online websites for any web development project. This may include, templates, scripts, images and other form of material that might be helpful in putting together your project. All such things will be copyrighted by Archer Networks or their respective owners and you may request a copy of such copyright policy from us.

11.) Indemnification

Customer agrees that it shall defend, indemnify, save and hold Archer Networks harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Archer Networks , its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Archer Networks against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Archer Networks ; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Archer Networks's server.

12.) Disclaimer

Archer Networks will not be responsible for any damages your business may suffer. Archer Networks makes no warranties of any kind, expressed or implied for services we provide. Archer Networks disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Archer Networks and its employees.

13.) Changes to the TOS

Archer Networks reserves the right to revise its policies at any time without notice.
